Scope of this Notice

This Privacy Notice for California Residents (“California Privacy Notice”) supplements the information contained in Domo’s general Privacy Notice, and applies only to visitors, users, and others who reside in the State of California. Terms defined in our Privacy Notice or the CCPA have the same meaning when used in this California Privacy Notice.

Information Collected by Domo

We collect information that identifies, relates to, describes, references, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer, household, or device ("Personal Information"). Personal Information does not include:

  • Publicly available information from government records;
  • Deidentified or aggregated consumer information; or
  • Information excluded from the CCPA's scope.

We’ve collected the following categories of Personal Information from consumers within the last twelve (12) months:

J. Non-public education information (per the Family Educational Rights and Privacy Act (20 U.S.C. Section 1232g, 34 C.F.R. Part 99)). Education records directly related to a student maintained by an educational institution or party acting on its behalf, such as grades, transcripts, class lists, student schedules, student identification codes, student financial information, or student disciplinary records. We obtain the categories of Personal Information listed above from the following categories of sources:

  • Directly from you, including when you register to use our services, attend an event or demonstration, interact with our social media or message boards, or fill out a web form;
  • Indirectly from you based on your use of our website or Services, including your device information, usage data, IP address, and interactions with features on our website or Subscription Services; or
  • From third parties, including parties that provide your information as a referral, collect Personal Information from other sources, or perform analytics from publicly available Personal Information.

We collected and used the Personal Information in the table above for the purposes identified in the section titled “Our Use of Personal Information We Collect” in our general Privacy Notice.

Personal Information Disclosed by Domo

We may share your Personal Information by disclosing it to a third party for a legitimate business purpose. We only make these business-purpose disclosures under written contracts that describe the purposes, require the recipient to protect the Personal Information, and prohibit using the disclosed information for any purpose not described in the contract. For more information about how and why we disclose this data, see the section titled “Disclosure of Information We Collect” in Domo’s general Privacy Notice. In the preceding twelve (12) months, Domo has disclosed Personal Information for business purposes to the categories of third parties indicated in the chart below.

Domo does not provide your personal information to third parties in exchange for money. However, the definition of “sale” under California law is broad and includes numerous other types of information disclosure, including for advertising purposes. Domo’s participation in digital network advertising may therefore constitute a "sale." We do not sell the personal information of consumers under the age of 16 if we have actual knowledge of the individual’s age. Domo also shares Personal Information with government and law enforcement agencies when we are required or believe we are required to provide such information in response to or to comply with a subpoena, court order, applicable law or regulation, government statute, legal or regulatory audit or investigation, or other legal process.

Your Rights and Choices under California Law

The CCPA provides California residents with specific rights regarding their personal information—including the right to know and access specific types of Personal Information, to learn how we process Personal Information, to request deletion or correction of Personal Information, to opt-out of sharing your Personal Information for third party advertising purposes, and not to be denied goods or services for exercising these rights. The section titled “Individual Rights” in our Privacy Notice further describes your rights and explains how to exercise those rights.
